国際的な制裁措置は、特にウクライナとロシア、米国と中国の二国間関係に関連する様々な地政学的展開において重要な役割を果たしています。制裁および輸出管理体制はますます複雑化しており、米国、英国、EUの規制当局にとって、制裁措置等の実施は最優先事項となっています。制裁措置等が多国籍企業に対して及ぼす影響は計り知れず、場合によっては多大な損失を伴う撤退、サプライチェーンの分離や変更につながることもあります。 国際的に事業を展開中、または国際的な事業展開を目指している日本企業は制裁措置による影響を特に受けています。制裁対象当事者との必要以上の接触や規制当局の不評を買うような事態を最小限に抑えるためには、バランスの取れたコンプライアンスとリスク軽減策が必要です。
本セミナーでは、日本やその他多国籍企業のクライアントに対して活発にアドバイス提供を行っている、米国、英国、EU各法域の制裁の専門家が、直近の制裁動向について最新の知見をご紹介します。トピックとしては、(a)ロシアと中国を対象とした最近の制裁の動向、(b)コンプライアンスとリスク軽減策、(c)制裁措置実施動向、に焦点を当てます。
International sanctions continue to play a key role in various geo-political developments, particularly related to Ukraine-Russia and US-China. Sanctions and export controls regimes are increasingly complex and their enforcement is a top regulatory priority in the US, the UK and the EU. The impact on multinational businesses has been immeasurable – in some cases leading to withdrawing at heavy discounts, decoupling or upending supply chains. Japanese companies with international operations and aspirations are particularly affected. Balanced compliance and risk mitigation measures are needed to minimize any unnecessary exposure to sanctioned parties or regulators’ wrath.
This seminar will include recent insights from our US, UK and EU sanctions experts who are actively engaged in advising Japanese and other multi-national clients on latest sanctions developments. We will focus on (a) Recent sanctions development targeting Russia and China; (b) Compliance and risk mitigation measures; and (c) Enforcement trends.

アレキサンダー・ドミトレンコはアシャーストの紛争解決部門、東京オフィスのパートナーです。アレキサンダーは規制コンプライアンス、社内調査、紛争解決を専門とし、17年以上のアドバイザリー経験を有しています。東京やニューヨークにおける業務を経験し、制裁および輸出規制、贈収賄および汚職、強制労働、サイバー犯罪問題、ESG、ならびにコンプライアンス関連のその他法規制に関する案件についてアジア企業に対する豊かなアドバイス提供の経験があります。また、ロシア、中国、ミャンマーイラン、キューバ、ベネズエラを対象とした米国やその他欧州諸国の制裁措置の遵守に伴う規制問題や潜在的な法の抵触に関するコンプライアンス上の課題およびリスク軽減対策についても、金融機関等のクライアントに助言を提供しています。

Alexander is a partner in Ashurst’s dispute resolution practice and is based in Tokyo. Through his practice in both New York and Tokyo over the last 17 years, Alexander has gained unique expertise in sanctions and export controls, anti-bribery and corruption, forced labour, cyber fraud, ESG and other compliance-related matters. His practice has been focusing on advising Japanese and other Asian companies on compliance with US and other western sanctions targeting Russia, China, Myanmar, Iran, Cuba and Venezuela. Alexander has extensive experience in conducting investigations, leading self-reporting processes, applying for regulatory licenses, advising on mitigating measures, enhancing compliance policies and procedures and conducting trainings. A significant part of this practice is involved in corporate transactions and projects through conducting due diligence and advising on risk mitigation and compliance system enhancements.
Alexander frequently writes and conducts media interviews related to sanctions developments. He teaches International Compliance at Temple University Law School Japan, where he is also the Chair of the Compliance Advisory Committee. He leads firm’s pro bono practice in Tokyo and serves as the Chair of TELL (a Japanese mental health NPO) and co-Chair of LLAN (a Japanese human rights NPO).

Tom is a partner in Ashurst’s dispute resolution practice and is based in London. He has advised clients in a range of industries, with an emphasis on the energy, resources and infrastructure sectors. Tom regularly advises international corporations on sanctions compliance and related issues. His work has involved advising on the preparation of sanctions compliance policies and accompanying staff training products; on whether transactions are permitted under sanctions legislation and the consequences of sanctions breaches; on contractual drafting to take account of sanctions risk, both in commercial contracts and loan agreements; and on dispute resolution matters arising from the imposition of sanctions.

Olivier is a partner in Ashurst’s dispute resolution practice and is based in Paris. He has over 15 years of experience and focuses on regulatory compliance, global investigations and, more generally, on financial and economic crime. His practice covers a wide spectrum of criminal and regulatory issues ranging from economic sanctions and export control rules to the fight against corruption, money laundering and terrorist financing as well as ESG and private environmental law. Olivier has developed significant experience in internal investigations – notably based on the extraterritorial application of U.S. and U.K anti-corruption, anti-money laundering, and economic sanctions rules – and has advised and represented numerous clients on these matters. Olivier regularly conducts compliance training, notably on corruption, economic sanctions and money-laundering risks. He also advises and represents French and European clients in proceedings before various French, European and American regulators.

Vicki is an associate in Ashurst’s dispute resolution practice and is based in Tokyo. Trained in New York, Vicki has experience working in major law firms in New York and Tokyo. Her practice areas span across sanctions and export controls, anti-bribery and corruption, anti-money laundering, and other compliance-related matters. Vicki communicates in fluent English, Mandarin and Japanese. Utilizing her language skills and legal expertise, Vicki has assisted numerous financial institutions and other international corporate clients in investigations, arbitrations, litigations and transactional matters. Since joining Ashurst Tokyo, Vicki has advised clients on sanctions/export controls due diligence, risk mitigation and compliance system enhancements, especially on US sanctions and export control measures against Russia and China. Vicki has also prepared client alerts on sanctions/export control compliance and supported various training sessions on sanctions/export control, cybersecurity and other compliance issues conducted by Ashurst for various Japanese universities and Japanese client organizations.
