＜概要／Summary＞

EUの外国補助金規制が2023年1月に施行され、外国補助金によるEU域内市場の競争の歪みを是正することを目的とした新たな制度を創設しました。大規模なEUビジネスの買収や公共入札に関与する日本企業は、広範な審査権限を持つ欧州委員会への新たな通知および承認要件の義務付けに直面する可能性があります。新たな通知および承認要件は2023年10月に発効する予定です。本セミナーでは、新規制の内容を詳しく解説し、日本企業への実務的な影響を検討するとともに、外国人投資家が新規則の発効に向けてどのように準備しているか、その経験を共有することを目的としています。

The EU’s Foreign Subsidies Regulation entered into force in January 2023 and creates a new regime aimed at combating distortions of competition on the EU internal market caused by foreign subsidies. Japanese companies involved in acquisitions of significant EU businesses and large EU public tenders may face new mandatory notification and approval requirements by the European Commission, which also has extensive powers to launch investigations. The new notification and approval requirements will take effect in October 2023. The purpose of the seminar is to review the substance of the new Regulation, consider the practical implications for Japanese companies, and share our experience with how foreign investors are preparing for the entry into force of the new rules.
