複雑なインフラプロジェクトはその性質上クロスボーダー案件となる傾向がこれまでにないほど高まっています。新興市場において経済の急速な発展に伴いインフラ設備の拡大・充実が望まれ、国際プロジェクトの能力・資金への需要は高まるばかりです。しかしながら、インフラプロジェクトは複雑である分、政治的リスクにさらされる可能性も高くなります。インフラプロジェクトは長期間存続し得るものであり、投資受入国にとって戦略的に重要な産業分野に属する場合が多く、その性質上、当該地域環境が敵対的なものとなった場合にも他へ移動させることができません。本セミナーでは、国際的な建設プロジェクトに関わるステークホルダーが、投資関連協定によりどのようにその権利を守ることができるか、とくに、投資家と受入国との間の紛争解決手段（investor-state dispute settlement; ISDS条項）について解説します。
More than ever before, complex infrastructure projects are cross-border in their nature. As a number of emerging markets look to scale up their infrastructure to meet the needs of a rapidly developing economy, the demand for international expertise and funding will only continue to grow. Given the nature of most complex infrastructure projects, however, they are inevitably exposed to a high degree of political risk. They can last many years, they will often be situated in sectors that are of strategic importance to the host state, and by their very nature, they cannot be relocated elsewhere if the local environment becomes hostile. This webinar will explore some of the protections that can be available to stakeholders in international construction projects in the form of investment treaties, and in particular through the investor-state dispute settlement (known as “ISDS”) mechanisms that those treaties provide for.
